About Conveyancing

  • What is conveyancing?

    The legal procedure of transferring legal ownership of real estate to you is known as conveyancing. Conveyancing procedures involve many legal representatives at various stages to ensure the transfer of legal interest to you is properly documented and registered. The settlement period to complete the whole process is normally 42 days.

  • What do conveyancers do?

    Conveyancing paralegals and conveyancers at our firm are professionals who specialise in conveyancing procedures. They have the experience and knowledge to manage every stage of your property purchase, from contract review and exchange to settlement. Continuous staff development and continuing legal education (CLE) is an important part of our firm's culture, so our staff are always up to date with the latest conveyancing procedures, knowledge and technologies.

  • Will you review the contract for me and what do you charge?

    Yes, it is best that we receive the draft contract for review before you sign it. We generally review contracts within 2 business days. Where you have accepted our fixed fee package, there is no charge for the first contract we review, as it is within the scope of our fixed fee.

  • What if someone has outbid me at the auction or in negotiations with the vendor's agent, so I need more than one contract reviewed?

    We would be happy to continue to support you. Our fee is $165.00 for each subsequent contract we review for you, and this includes review and negotiations to amend unfair terms and conditions.

  • How do I pay the deposit?

    Ordinarily, the vendor's real estate agency will hold your deposit in their company's statutory trust account. Sometimes, the contract will specify that the vendor's solicitor will hold it in their solicitor's trust account. You usually receive account details for this by email, however, you should phone their office to confirm that any account number you have been given is correct before you EFT the money. There are many scammers and many incidents of cyber fraud these days, so it is best to get verbal confirmation before you send money electronically.

  • Should I have a cooling off period?

    An exchange of contracts with a cooling off period of 5 business days secures the property for you and gives you the opportunity to continue with due diligence enquiries and obtain an unconditional finance approval letter. Your lender can obtain a market valuation report, and you can obtain a strata inspection report or building and pest inspection report during the cooling off period.

  • How long is the cooling off period?

    The standard cooling off period is 5 business days, but if you will need more time to get your finances organised or your loan approved, you should ask for 10 business days when you make your offer to buy the property. If you discover for any reason that you should not proceed with the purchase, you can terminate the contract, and your 0.25% deposit will be forfeited. This is better than risking a full deposit.

  • How do I terminate the contract during the cooling off period?

    Ask us to issue a formal rescission notice on your behalf. It is best to contact us the day before expiry of the cooling off period to discuss ending the contract.

  • What if the cooling off period is about to expire and my lender needs more time?

    It is best to contact us the day before expiry of the cooling off period to discuss requesting an extension if you need more time to sort your loan or any other issue.

First Home Buyers

  • Is there a first home buyer's duty concession or exemption for me?

    Yes, where you have never owned real estate in Australia before and you are an Australian citizen or permanent resident, you could qualify. It depends on whether the property you are buying is below the price threshold and whether you have all the correct identity documents for the application. We can assist you with it.

  • My spouse has owned a property before, can I qualify as a first home buyer?

    Where your spouse or de facto partner has owned a property in Australia, you would not qualify.

  • I had a property a long time ago, can I still get a duty concession or exemption?

    You could qualify where you owned land only, without a dwelling on it, but you should contact us or Revenue NSW to determine if the rules have changed. Similarly, you could qualify where you were registered on the title of the property only as the trustee of an estate. You will need to discuss your circumstances with us or Revenue NSW for confirmation.

  • It is my first purchase of real estate and there is so much information for me to understand, can I meet you?

    Yes, we encourage first home buyers to meet us. Meetings are by appointment, as our staff schedule their time to work from home and at the office. Meetings can be held in person in our conference room, or via a Teams video call, to discuss details and answer your questions. Please phone us to make the appointment.
